Terms & Conditions
These Terms and Conditions apply when you purchase from Jason D’Souza Heritage as a consumer (a private individual buying for personal use).
They are designed to ensure clarity, fairness, and compliance with UK consumer protection law.

Jason D’Souza Heritage — Consumer Terms and Conditions of Sale
1. Quotations
Quotations are valid for 4 weeks unless previously withdrawn.
Quotations do not constitute a binding offer until your order has been confirmed and payment received.
2. Orders
All orders must be confirmed in writing.
Please check your order carefully before confirming, as many of our fabrics are cut to your required length and cannot be cancelled or returned once processed.
3. Prices, Carriage and VAT
All prices are shown in pounds sterling (£) and include VAT at the current rate.
Carriage and handling charges apply to all orders and will be shown at checkout or on your invoice.
4. Delivery
We will confirm an estimated delivery date once your order is accepted.
While we make every effort to deliver promptly, delivery times may vary depending on stock and courier schedules.
If your order is delayed, we will notify you as soon as possible.
You have the right to cancel your order and receive a full refund if delivery exceeds 30 days, unless you have agreed otherwise in writing.
5. Goods Lost or Damaged in Transit
Please inspect your goods carefully on delivery.
If items are damaged or missing, please contact us within 48 hours of receipt by email at admin@jasondsouza.co.uk
If goods appear damaged on arrival, please sign for them as such and notify us immediately.
This helps us resolve the matter quickly with our carrier.

6. Damaged or Defective Goods
Please check all fabrics and wallpapers carefully before cutting, hanging, or upholstering.
If you believe an item is damaged or defective, notify us within 48 hours of receipt and do not cut or use the goods.
We cannot accept responsibility for any issue once the fabric or wallpaper has been cut, hung, or installed.
If in doubt, stop work and contact us immediately.
If goods are proven to be defective, you are entitled to a replacement, repair, or refund in line with the Consumer Rights Act 2015.

7. Creasing
All fabrics should be inspected within 48 hours of receipt.
Please report any concerns about creasing during this period.
We are not responsible for creasing that occurs after delivery or due to incorrect storage.
All fabrics should be stored horizontally in a clean, dry environment.

8. Cancellations and Right to Cancel
If you order online, by phone, or by email, you have a legal right to cancel your order within 14 days of receiving your goods.
To cancel, please notify us in writing at admin@jasondsouza.co.uk
However, your right to cancel does not apply to:

Fabrics cut to your specified length;
-
Custom or made-to-order products;
-
Items treated for flame retardancy or stain resistance.
If you cancel within the cooling-off period (and the goods are not excluded), we will refund you in full, including standard delivery costs, within 14 days of receiving the goods back in unused condition.
You are responsible for return postage costs.

9. Returns
Returns will be accepted in accordance with your consumer rights.
Please contact us before sending any items back.
Goods must be returned in their original, unused condition.
We cannot accept returns for any fabric that has been cut, hung, or treated.
Refunds will be made via the same method used for payment once we have received and inspected the goods.
10. Product Information and Suitability
Colour Matching
While every effort is made to ensure accurate colour representation, slight variations may occur between batches and between screen displays and physical samples.
We recommend ordering a sample before purchasing.
Colour Fastness
Our fabrics are produced to high standards, but no fabric is completely fade-resistant.
Prolonged exposure to sunlight may cause fading; lining or protective window treatments are recommended.
Use for Upholstery
Please check suitability before ordering.
Unless stated otherwise, fabrics are not guaranteed as suitable for heavy-use upholstery applications.
Cleaning
We recommend professional dry cleaning for all our fabrics.
Ensure that the cleaning method is suitable for the specific material and dyes.
We are not responsible for damage caused by improper or unsuitable cleaning.

11. Flame-Proofing
All our fabrics are sold without flame-retardant (FR) treatment unless stated otherwise.
Certain projects may require fabrics to meet specific FR standards.
It is the customer’s responsibility to confirm these requirements before ordering.
If fabrics are treated after purchase, please allow approximately 5% shrinkage and note that we accept no liability for any change in appearance, texture, or performance following treatment.

12. Liability
Nothing in these terms limits or excludes our liability for:

Death or personal injury caused by our negligence,

Fraud or fraudulent misrepresentation, or
-
Any matter which cannot be limited under UK law.
For all other claims, our liability is limited to the price paid for the goods in question.
We are not liable for any indirect or consequential losses arising from use of our products.

13. Payment
Payment is required in full at the time of order.
We accept major credit and debit cards, and other methods as listed on our website.
Orders will not be processed until payment has cleared.

14. Notifications
All notifications should be made by email to sales@jasondsouza.co.uk or by post to our registered address.

15. Variations
We may update these Terms and Conditions or our prices from time to time.
The terms in force at the time of your order will apply to that purchase.

16. Governing Law
These Terms and Conditions and any disputes arising under them are governed by the laws of England and Wales and subject to the exclusive jurisdiction of the English courts.
